Mr. Lan served as a legal counsel at a central construction enterprise for a long time. He has accumulated rich experience in construction projects, including litigation and non-litigation matters in the field of construction. He has a deep insight of the construction industry, construction management and risk prevention and control, and engineering project risk management.
In his position as an in-house legal counsel, he participated in the handling of a series of lawsuits between the company and a well-known real estate developer, including a dispute concerning work period with RMB 160 million in claims, a dispute concerning project settlement with RMB 1.5 billion in claims, a dispute concerning project settlement with RMB 360 million in claims. Through his solid evidence organization and property preservation measures, the developer and the general contractor were forced to reach a mediation agreement. He participated in the arbitration among the company, the developer and the designated subcontractor. Through careful analysis of the legal relationship, performance of the contract, and allocation of responsibilities, his legal opinion was finally adopted by the arbitral tribunal, which dismissed the claim of RMB 40 million raised by the developer against the general contractor. He represented a business entity against a labor service subcontractor, and recovered the loan and construction cost of RMB 16 million for the client.
After he started his career as a practicing lawyer, Mr. Lan participated in the handling of many disputes between construction companies and owners, material suppliers, labor service companies, and actual constructors, as well as non-litigation projects such as acquisition of projects under construction. He assisted his team in providing the whole-process risk management and control services for various construction companies, improving the standardization, informationize and normalization of project management of small and medium-sized construction companies, and help construction companies prevent and control various types of risks during the performance of contracts.
