商业诋毁行为既包括捏造、散布虚假事实,对真实情况的恶意歪曲,也包括不公正、不准确、不全面地陈述客观事实,意在贬低、诋毁竞争对手的商誉。
2.向非消费者群体散布虚假信息。尽管《反不正当竞争法》第十一条中并未明确商业诋毁行为中虚伪信息的传播对象,但经营者仍应认识到第十一条的本意在于保护经营者的正当竞争权益,如果虚伪信息的传播导致经营者的商誉受损、交易机会丧失或有丧失之虞,则不论其传播对象是消费者还是向竞争对手、同业经营者,均可被认定为商业诋毁。
